GroundScope — Terms of Use

These terms govern the GroundScope ground-investigation application. They are separate from, and in addition to, the website Terms of Service and Privacy Policy. Where you have a signed order or agreement with us for GroundScope, that agreement takes precedence if it conflicts with these terms.
Account access may use Google authorisation (Google Sign-In); where it does, Google verifies your identity and we do not store your Google password. Paid access is sold through Paddle as Merchant of Record. Your use of this product is also subject to our Acceptable Use Policy and Refund & Cancellation Policy.
1. About these terms
GroundScope ("Service") is provided by GO360 Limited ("GO360.biz", "we", "us"), a company incorporated in the Isle of Man with company number 139095C, registered office [REGISTERED OFFICE ADDRESS, ISLE OF MAN]. By accessing or using GroundScope you agree to these terms.
2. The Service
GroundScope is a ground-investigation workspace for managing site investigation work items — including site intake, geology lookup, hazard assessment, borehole logging, environmental searches, and the generation of Ground Investigation Reports.
3. Access, accounts and authentication
Access is restricted to authorised, authenticated users within your organisation. You are responsible for keeping credentials secure, for activity under your account, and for your users' compliance with these terms. We may suspend access to protect the Service or other users.
4. Commercial terms
Access is provided under the order, subscription, or written agreement entered into between you and us. Where no separate agreement exists, the Service may be made available for evaluation or demonstration only, on an "as is" basis and with no warranty.
5. Your data and content
You retain all rights in the data, drawings, logs, and reports you or your users submit ("Customer Data"). You grant us a non-exclusive licence to host, process, and transmit Customer Data solely to provide and support the Service. You are responsible for ensuring you have the rights and lawful bases to provide Customer Data (including any personal data), and for its accuracy and legality. We process personal data in accordance with our Privacy Policy and any data processing terms agreed with you.
6. Professional outputs and reliance
GroundScope is a tool to support qualified professionals. Geological, hazard, and environmental information drawn from third-party sources is provided for reference and may be incomplete or inaccurate. Reports and assessments produced using the Service remain the professional responsibility of the user and their organisation, and must be independently checked. We give no warranty as to the suitability of outputs for any particular purpose.
7. Acceptable use
You must not use the Service unlawfully, attempt unauthorised access, disrupt or reverse engineer it (except as permitted by law), upload malicious code, or infringe the rights of others.
8. Intellectual property
The Service, including its software, design, and content (excluding Customer Data and third-party open-source components), is owned by or licensed to GO360.biz. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes during the term.
9. Third-party services and data
The Service is hosted on Cloudflare and uses third-party geospatial data and services, including British Geological Survey (BGS) APIs and map layers, and web map (WMS) tile providers. Such data is subject to the providers' own terms and licences. Where the optional server-side hazard backend is used, it may rely on PostgreSQL/PostGIS. We are not responsible for third-party services or the accuracy of third-party data.
10. Open-source software acknowledgements
GroundScope is built with open-source software. We acknowledge and thank the authors of the principal components below. Each remains the property of its respective authors and is used under its own licence:

11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we exclude all implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
Nothing limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud). Subject to that, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue, business, goodwill, data, or anticipated savings, arising from use of the Service. Where you have a separate agreement with us, any liability cap in that agreement applies.
13. Indemnity
You agree to indemnify us against claims and reasonable costs arising from your misuse of the Service, your Customer Data, or your breach of these terms.
14. Term and termination
These terms apply while you use the Service. We may suspend or terminate access for breach or to comply with law. On termination, your right to use the Service ends; Customer Data is handled in line with any agreed data terms and our retention practices.
15. Governing law and jurisdiction
These terms are governed by the law of the Isle of Man, and the courts of the Isle of Man have exclusive jurisdiction, subject to any contrary provision in a separate signed agreement.
